Terms of Service
Last updated · 16 June 2026
These terms set out the agreement between you and STENDHAL. We have kept them as clear as the law allows — please read them before entering the museum.
01Who we are
STENDHAL ("STENDHAL", "we", "us") operates a global, invitation-only platform and virtual museum that presents artworks and connects artists, designers, and collectors. These Terms of Service ("Terms") govern your access to and use of our website and services (the "Platform").
By accessing the Platform, requesting an invitation, or creating an account, you agree to these Terms. If you do not agree, please do not use the Platform.
02Invitations & accounts
The Platform is invite-only. Requesting an invitation does not guarantee access; admission is at our sole discretion. We may decline, suspend, or revoke access at any time.
If you are granted an account, you are responsible for keeping your credentials confidential and for all activity under your account. You must be at least 18 years old, or the age of majority in your jurisdiction, to hold an account.
You agree to provide accurate information and to keep it current. Impersonation, misrepresentation, or fraudulent use of an invitation may result in immediate termination.
03Artists, works & ownership
Artists retain full ownership of and copyright in the works they submit. By listing a work, you grant STENDHAL a non-exclusive, worldwide, royalty-free licence to display, reproduce, and promote that work for the purpose of operating and marketing the Platform.
You represent that you own or control all rights to the works you submit, and that they do not infringe the intellectual property, privacy, or other rights of any third party.
We may remove any work or content that we reasonably believe violates these Terms, applicable law, or the rights of others.
04Sales & the Resonance Commission
Where the Platform facilitates a sale, artists keep seventy-seven percent (77%) of the sale price, and STENDHAL retains a twenty-three percent (23%) commission (the "Resonance Commission"), unless otherwise agreed in writing.
Prices, taxes, shipping, payment processing, and settlement timelines will be described at the point of sale. You are responsible for any taxes applicable to your transactions.
Commissions, fees, and payout terms may change with notice. Changes will not apply retroactively to completed transactions.
05Acceptable use
You agree not to misuse the Platform: no unlawful, infringing, fraudulent, or harmful activity; no scraping, reverse engineering, or circumventing access controls; no uploading of malware; and no attempts to disrupt the Platform or its security.
You will not use the Platform to launder money, sell counterfeit works, or misrepresent provenance, authorship, or authenticity.
06Intellectual property of the Platform
The STENDHAL name, wordmark, design, software, and all Platform materials (excluding artist-submitted works) are owned by STENDHAL or its licensors and are protected by intellectual property laws. You may not copy, modify, or create derivative works from them without our written permission.
07Disclaimers & liability
The Platform is provided "as is" and "as available", without warranties of any kind, to the fullest extent permitted by law. We do not guarantee uninterrupted or error-free operation.
To the maximum extent permitted by law, STENDHAL will not be liable for indirect, incidental, special, or consequential damages, or for any loss of profits, data, or goodwill arising from your use of the Platform.
08Termination
We may suspend or terminate your access at any time, with or without cause. You may stop using the Platform at any time. Provisions that by their nature should survive termination (including ownership, disclaimers, and limitations of liability) will survive.
09Changes & contact
We may update these Terms from time to time. Material changes will be communicated through the Platform or by email. Continued use after changes take effect constitutes acceptance.
